Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of PutOn ("the App", "the Service", "we", "us"). By accessing or using PutOn, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use PutOn.

You must be at least 13 years old to use PutOn. By using the Service, you confirm that you meet this requirement.

2. Using PutOn

Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us immediately at [email protected] if you suspect unauthorised access to your account.

Creator accounts

Creator accounts are free. You can create an account using a valid email address and choose a username. You agree to provide accurate information when registering.

Brand accounts

Brand accounts require an approved application and an active paid subscription. See Section 4 for details on brand account terms and payments.

3. Your Content

Ownership

You retain ownership of the content you post on PutOn, including outfit photos, descriptions, and other materials ("Your Content").

License to PutOn

By posting content on PutOn, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute Your Content solely for the purpose of operating and promoting the PutOn service. This license ends when you delete your content or your account.

Your responsibilities

You are responsible for Your Content. You represent and warrant that:

• You own or have the necessary rights to post the content
• Your content does not infringe any third-party intellectual property rights
• Your content does not violate any applicable laws
• Your content complies with these Terms

Content removal

We reserve the right to remove content that violates these Terms or our community guidelines, without prior notice.

4. Brand Accounts & Payments

Application & approval

Brand accounts are subject to application and manual review. Submitting an application does not guarantee approval. We reserve the right to approve or decline applications at our discretion.

Subscription pricing

Brand access is available at $100 USD per month. Prices are subject to change with 30 days' notice.

Billing

Your payment method will be charged upon approval of your brand application. Subsequent charges occur on a monthly basis on your billing date. Payments are processed by Stripe and are subject to Stripe's terms and privacy policy.

Cancellation

You may cancel your brand subscription at any time from within the PutOn app. Cancellations take effect at the end of your current billing period — you retain access until that date. We do not offer refunds for partial months.

Failed payments

If a payment fails, we will attempt to process it again over the following 3 days. If payment cannot be collected after this period, your brand account will be suspended until payment is resolved. You can update your payment method in the app.

5. Prohibited Conduct

You agree not to:

• Post content that is illegal, harmful, threatening, abusive, defamatory, or obscene
• Impersonate any person or entity, including other users or brands
• Post content that infringes on intellectual property rights
• Use PutOn to spam, harass, or harm other users
• Attempt to gain unauthorised access to any part of the Service
• Use automated tools (bots, scrapers) to access or collect data from PutOn
• Post false or misleading information about brands or products
• Attempt to reverse engineer or compromise the security of PutOn

Violation of these rules may result in content removal, account suspension, or permanent termination.

6. Intellectual Property

PutOn and its original content, features, and functionality are owned by PutOn and are protected by copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

The "PutOn" name, logo, and all related marks are our exclusive property.

7. Termination

We may suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may delete your account at any time from within the app. Upon deletion, your data will be removed in accordance with our Privacy Policy.

For brand accounts, termination by us does not entitle you to a refund of prepaid subscription fees, except where required by applicable law.

8. Disclaimers & Limitation of Liability

PutOn is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the maximum extent permitted by law, PutOn shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from these Terms or your use of PutOn shall not exceed the amount you paid to us in the 12 months preceding the claim.

9. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of PutOn shall be resolved through good-faith negotiation. If a dispute cannot be resolved informally, it shall be subject to binding arbitration.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the app or email at least 14 days before they take effect. Your continued use of PutOn after changes take effect constitutes your acceptance of the updated Terms.
